Petitioner and the private respondents are related as landlord and tenant. The petitioner apprehends that his property is being encroached and used by the private respondents.

Learned advocate appearing for the private respondent nos. 9 to 12 disputes the same and submits that they have been victimised and the petitioner is trying to invoke the jurisdiction under Article 226 of the Constitution of India.

Records reflect that the petitioner has already approached the learned Executive Magistrate by way of filing an application under Sections 126/152/163 of the BNSS, 2023.

Learned advocate for the State is present.

Having considered that the dispute is absolutely civil in nature, the petitioner would be at liberty to approach the appropriate forum. In the meantime, the police authorities would see that no breach of peace and/or tranquility takes place in

respect of the issues of dispute between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 25494 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
