Present petition has been filed for transfer of Matrimonial Suit No.1491 of 2023 having been filed by the opposite party/husband.
Learned counsel for the petitioner submits that presently the matter is pending before the learned Additional District Judge, Fast Track Court at Barrackpore, North 24 Parganas.
Learned counsel submits that the matter may be transferred to the jurisdictional court of the learned Additional District Judge, Sealdah.
Learned counsel submits that pursuant to the order dated 4th July, 2024, the applicant was directed to send a copy of the application upon the opposite party and the same has already been served.
Mr. Dalapati, learned counsel for the opposite party on instruction has graciously submitted that the matter as prayed for may be transferred and a direction may be issued to the learned Trial Court for expeditious disposal of the matter preferably within six months.
In view of the submissions, the Matrimonial Suit No.1491 of 2023 is withdrawn from the court of the learned Additional District Judge, Fast Track Court at Barrackpore, North 24 Parganas and assigned to the jurisdictional court of learned Additional District Judge, Sealdah. Learned Trial Court shall dispose of the matter expeditiously preferably within a period of six months and without granting any unnecessary adjournments.
Accordingly, CO 3709 of 2023 is disposed of.
Copy of the order be sent to the transferee court.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
