Samir Bhattacharjee v. Mitul @ Runu Bhattacharjee
01.04.2024 Sl. No. 14 Ct. No. 655 Srimanta IA No.:CAN/1/2016 (Old No.:CAN/2897/2016) in CO/3597/2015 Sri Samir Bhattacharjee -Vs.- Smt. Mitul @ Runu Bhattacharjee Both the parties are not represented.
The instant revisional application is filed under Article 227 of the Constitution of India challenging the impugned order dated 27.08.2015 passed by the learned Trial Court. By passing the impugned order learned Trial Court stayed further proceeding of the Matrimonial Suit being No. 229/2010 as the petitioner herein has failed to comply the order passed by the Trial Court by which he was directed to pay the arrear alimony for the period from July, 2012 to May, 2013 and also failed to pay the litigation cost as awarded by the learned Trial Court to the tune of Rs. 10,000/-. Being aggrieved and dissatisfied with the said impugned order the present petitioner/husband has preferred this revisional application. It further appears that the matter is pending since the year 2015 and as such there is no justification to keep this revisional application alive in the list. Accordingly, the revisional application being CO/3597/2015 is dismissed for default.
Consequently, the application being CAN/1/2016 (Old No.:CAN/2897/2016) is also dismissed.
Interim order, if any, stands vacated.
There will be no order as to costs.
