Learned counsel for the petitioner contends that the petitioner's application for organizing a small Puja has not been responded to by the respondent-authorities.

Learned counsel for the State hands over a written instruction/report authored by the concerned Inspector of Police which indicates that the proposed site of the Puja is near the wall of a Muslim burial ground. That apart, the Puja is proposed to be held in a narrow alley, which might prevent the ingress and egress to the main road.

Such contentions are disputed by the petitioner. 4.

Be that as it may, since the petitioner has sought to organize the Puja, it is for the respondentauthorities to consider the said application in

accordance with law and render a proper decision on the same.

Accordingly, WPA No. 24451 of 2023 is disposed of by directing the respondent-authorities to consider and dispose of the application of the petitioner for organizing a Durga Puja this year in accordance with law and, upon adverting to the same, to intimate the reasoned outcome of the same to the petitioner. The entire exercise shall be completed by October 18, 2023.

It is made clear that the merits of the petitioner's application to organize such Puja have not been entered into by this court.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
