Ddd v. State Of West Bengal And ANR
M/L 288 29.01.2026 Bpg.
Dismissed C.R.M. (M) 2233 of 2025 In Re: An application for bail Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Ashoknagar Police Station Case No.244 of 2022 dated 01.04.2022 under Section 376(2)(f) of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act, 2012;
DDD
Versus
The State of West Bengal & Anr.
Mr. Poulam Dey Ms. Bidisha Chakraborty.
...for the petitioner.
Ms. Faria Hossain Ms. Rituparna Saha.
...for the State.
Mr. Debottam Das.
...for the de facto complainant.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 9 months. On the other hand, learned advocate for the State submits that only the evidence of the investigating officer is left. Having considered the belated stage for filing the bail application and the final stages of the prosecution case, I am not inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner in CRM(M)2233 of 2025 is dismissed.
However, the learned trial court would ensure that a final verdict is pronounced within a reasonable time.
Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
