In furtherance to the direction passed by this Court on September 29, 2023 in WPA 23706 of 2023 (Ramkrishna Mukherjee & Ors. v. Eastern & North East Frontier Railway Co-operative Bank Limited & Ors.) the petitioners have preferred an appeal before the Central Registrar of Co-operative Societies. The same is pending consideration.

The election is scheduled to be held tomorrow that is on October 12, 2023.

At this stage it will not be proper to interfere with the process of election. The election that is fixed tomorrow is directed to be conducted subject to the result of the application which is pending consideration

before the Special Secretary and the Central Registrar of Co-operative Societies.

The Central Registrar of Co-operative Societies is directed to decide the pending issue at the earliest but positively within a period of eight weeks from the date of communication of this order.

The writ petition stands disposed of.

Affidavit-of-service filed in Court today is taken on record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
