Learned counsel for the petitioners submits that in a criminal case lodged against them being Sinthi Police Station case no. 19 of 2013 registered as G.R. case no. 369 of 2013 they are allowed to renew their passport from the concerned authority for a period of two years, if the same was permissible as per passport rules subject to certain conditions. An objection was received by the petitioners from the Regional Passport Office, Kolkata requesting them to appear before the office on the ground that an adverse police verification report was received against the petitioners in connection with Sinthi Police Station case no. 19 of 2023 dated 1st February, 2023 by the police authority. It appears from the report and is also submitted by the State that in the report submitted by the police Sinthi Police Station case no. 19 dated 1st February, 2013 has been wrongly recorded as Sinthi Police Station case no. 19 dated 1st February, 2023. The petitioners have prayed for permission for renewal of their passport in connection with Sinthi Police Station
case no. 19 dated 1st February, 2013 which is the only case pending against them .
In view of the above, the police authority is directed to furnish a fresh report before the passport authority with the correct P.S case no. in order to enable the passport authority to take necessary steps for renewal of the passport of the petitioners in terms of the order of the learned Magistrate, in accordance with law.
With the above observations and directions, the writ petition is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
