Affidavit of service filed by the petitioner is taken on record.

None appears for the respondent despite service. The petitioners allege that the private respondent has recorded his name in the record or rights by producing a false and fabricated deed purportedly executed and registered in his favour. The petitioners lodged a complaint before the police authority on 25th September, 2025 which has not been taken into consideration.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that since admittedly no step has been taken by the police authority pursuant to the complaint lodged by the petitioners, the petitioners are at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS for redressal of their grievance.

With the aforesaid direction, the writ petition is disposed of.

There shall however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
