The State of West Bengal and others Ms. Benazir Shaikh, Mr. Ibrahim Shaikh, Advocates ... for the petitioner Mr. Jahar Lal De, Mr. Rudranil Dey, Advocates ... for the State The issue raised in this public interest petition is that there are about 100 job card holders under the MGNREGA Project, who have worked but have not been paid. The allegation in the petition is that the amount has been misappropriated by some responsible persons.

When the petition is taken up, learned counsel for the petitioner has pointed out that a detailed representation dated 15.10.2022 in this regard has already been submitted before the respondent No.4 (District Magistrate, Nadia), but no action has been taken on the said representation.

Learned counsel for the petitioner has prayed for appropriate decision on the said representation. Learned counsel for the State has submitted that he has no objection in deciding the said representation, therefore we dispose of the present petition by directing the respondent No.4 to duly consider the petitioner's representation dated 15.10.2022 in accordance with law. If the respondent No.4 feels that an opportunity of

WPA (P) 561 of 2022 hearing is required, then the same be offered to the petitioner and all the concerned affected parties. Let this exercise be completed within a period of 3 months from the date of receipt of the copy of this order.
