The petitioner alleges that an unauthorised construction has been undertaken by his neighbour, respondent no. 4. It is claimed that respondent no. 4 has carried out construction on the relevant plot of land without altering the character of the land and without obtaining any sanctioned building plan.

Learned counsel appearing for the petitioner has, however, produced a copy of a sanctioned plan as well as a conversion certificate issued by the competent authority. It is further submitted that the petitioner has already instituted a civil suit alleging encroachment by respondent no. 4, and that the competent Civil Court has declined to grant an interim order of injunction. Copies of the sanctioned plan and the conversion certificate have been placed before both the learned advocate for the petitioner and this Court.

Let copies of the sanctioned plan and the conversion certificate be kept with the records. In view of the foregoing, this Court is of the opinion that the petitioner's allegations are without merit. Accordingly, WPA 25312 of 2025 is dismissed.
