Mr. D.N.Ray Mr. Bhaskar Mukherjee Ms. Nafisa Yasmin Mr. Debdutta Dutta ... for the petitioner Ms. Tapati Samanta ... for the State Mr. Sanjoy Saha ... for the respondent no. 7 Pursuant to the order dated 30th January, 2023 matter is taken up for consideration in presence of the learned advocates representing the petitioner, School authority as well as the State respondents.
Mr. Saha, learned advocate, representing the School authority submits that in terms of the direction as contained in the previous order dated 30th January, 2023 petitioner attended the office of the Teacher-in-Charge of the concerned school on 6th February, 2023 and subsequently all formalities were complete on 9th February, 2023 with the cooperation of the petitioner by the said school authority relating to preparation of pension papers of the petitioner. It has been submitted on behalf of the school authority that on 9th February, 2023 itself effort was made to transmit the soft copy of the pension papers of the petitioner to the office of
the concerned District Inspector of Schools but the same could not be done since the designated portal was locked.
However, subsequently on 16th February, 2023 soft copy of the pension papers were transmitted to the office of the concerned District Inspector of Schools in terms of norms. In addition thereto it has also been submitted on behalf of the school authority that the hard copy of the pension papers were submitted in the office of the concerned District Inspector of Schools on 15th February, 2023.
In view of submission of pension papers by the said school authority the requirement to file a report in terms of the previous order passed by this Court stands waived.
Ms. Samanta, learned advocate, representing the State respondents including the concerned District Inspector of Schools has prayed for some time to process the pension case of the petitioner. Accordingly, the District Inspector of Schools (SE), Howrah, being respondent no. 4 is directed to settle the pension case within a period of two weeks from date and forward the pension papers to the Directorate of Pension, Provident Fund and Group Insurance. On receipt of such pension papers the Director of Pension, Provident Fund and Group Insurance, being respondent no. 3 is directed to issue pension payment order in favour of the petitioner within two weeks thereafter.
On issuance of pension payment order respondent authorities are directed to release the
pensionary benefits in favour of the petitioner within two weeks thereafter.
With the aforesaid direction the writ petition stands disposed of. However, there shall be no order as to costs.
The prayer for payment of interest on delayed payment of retiral dues has been made on behalf of the petitioner but the same has not been gone into in this writ petition since pension payment order has not yet been issued. On issuance of pension payment order if the grievance of the petitioner persists, she shall be at liberty to take steps in accordance with law, if so advised. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
