1. The matter pertains to an illegal construction. Accordingly, this Court by order dated 18th May 2026 had directed the Municipality to carry out an inspection within 3 days from the date of receipt of this order and to file a report.

2. The municipality has since filed an affidavit enclosing a photocopy of the report. The original report has not been filed before this Court. The report reads as follows :- REPORT RE: WPA No. 25343 of 2025 Imran Khan Vs State of West Bengal & Others Address : 69/1, Noor Md Munshi Lane, Howrah-1, Ward - 19 As per order dated 18.05.2026 passed by Lordship Hon'ble Justife Raja Basu Chowdhury

Report as follows:

1) The building is G+4 Storied

2) The building is vacate

3) During spot inspection have been seen the construction is being kept stop

4) The G+4 building is not out Borough-III jurisdiction matter and building department to take step Assistant Engineer Borough-III Howrah Municipal Corporation

3. It is unfortunate that the municipality, despite specific direction from this Court has recorded that the building is not within the jurisdiction and it is for the building department to take steps. The report is absolutely bald. No disclosure has been made as to whether the construction is in accordance with the sanctioned building plan. No particulars of the plan, if at all sanctioned by the municipality has been disclosed.

4. Having regard thereto, I direct the Assistant Engineer, Borough-III, Howrah Municipal Corporation to be personally present before this Court today at 2.00 P.M. and explain the circumstances under which the aforesaid recording has been made in his report dated 23rd June 2026.
