The matter is listed today for hearing. It is an old revisional application pending since the year 2011, but till date no notice has been served upon the opposite parties. No interim order is there. The petitioners have prayed for quashing of Domjur Police Station Case No. 678 of 2011 dated 2.12.2011 pending before learned Chief Judicial Magistrate, Howrah.

Mr. Binay Panda along with Mr. Subham Bhakat, learned advocates appear for the State. The appointments of concerned advocates be regularized by the concerned authority.

It is submitted by learned advocates for the State that the main contention of the petitioners is that how opposite party no. 2, a resident of Mumbai can lodge this complaint to initiate Domjur Police Station Case No. 678 of 2011. It is submitted that this revisional application is frivolous and necessary order may be passed.

Considered the submissions and perused the application for revision. It is a settled principle of law that in initiating a criminal

proceeding, locus standi of a person cannot be questioned, as an offence can be disclosed before the Investigating Agency by anyone. Accordingly, this revisional application is dismissed in limine. Let a copy of this order be sent to the Learned Chief Judicial Magistrate, Howrah for information.
