The petitioner alleges that the private respondents are restraining him from entering his property and are threatening him with dire consequences.

The petitioner lodged complaint before the police authority in this regard which has not been acted upon. The private respondents deny and dispute the allegations made by the petitioner.

It is not in dispute that the complaint lodged by the petitioner has not been considered by the police authority. In such event, the petitioner is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS for redressal of his grievance.

In the meantime, since the petitioner apprehends threat to his life and property, the police authority shall keep strict vigil in the area in order to avoid any untoward

incident and shall ensure maintenance of peace and tranquility.

The police shall render necessary assistance/protection to the petitioner as and when sought so that the petitioner is able to reside in his property peacefully and without any disturbance from any corner whatsoever.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
