The matter is listed today for hearing as contested application. None appears for the petitioner. Mr. Binoy Panda along with Mr. Pratick Bose, learned advocates appear for the State/O.P. No. 1. The appointments of the State advocates may be regularized by the concerned authority.

This revisional application has been filed assailing an order dated 24.8.2011 passed by learned Judicial Magistrate, 1st Court, Siliguri, District - Darjeeling in Misc. Case No. 64 of 2010 arising out of M.R. No. 80 of 2004 whereby the petitioner/husband was directed to pay arrear maintenance to his wife to the tune of Rs.75,000/- in 10 (ten) equal instalments.

After filing of the revisional application, this Court also directed the petitioner to pay the arrear maintenance in instalments. There is no indication whether the said order has been complied. The revisional application is, therefore, dismissed for default of the petitioner. Let a copy of this order be sent down to the 1st Court of learned Judicial Magistrate, Siliguri for information and necessary action.
