Versus

Md. Mustafa (Through Video Conference) The appellant is not represented either physically or virtually. No accommodation is prayed for on behalf of the appellant. The application for admission of appeal was heard on 4th October, 2016 and it appears that the matter was not pursued. We made it clear in our previous order that in the event the appellant is not represented, we shall peruse the order and decide the matter in absence of the appellant.

We have perused the order under appeal. We find no reason to interfere with the order passed by the learned trial court at the adinterim stage. Moreover, it appears that 8th November, 2016 was fixed for framing of issue.

We dispose of this matter by directing the learned trial court to dispose of the suit as expeditiously as possible, if it has not yet been disposed of.
