By such order, interim anticipatory bail was granted by the co-ordinate Bench.

It is submitted at the Bar that the co-ordinate Bench did not consider the materials in the case diary and passed such order in view of the ensuing Puja vacation.

We perused the materials in the case diary.

The police complaint was lodged within 5 years of marriage.

The de facto complainant recorded a statement under Section 164 of the Criminal Procedure Code where, she implicates the petitioner, who is her husband, in the incident of assault, torture, both mentally and physically and demand for

dowry. In fact, she states that, a large amount was transferred by bank transaction as also cash.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to confirm the interim anticipatory bail granted on October 17, 2023 or grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 4754 of 2023 is dismissed.
