The communication sent by way of report by the Officer-incharge Islampur Police Station be kept with the record. The report reflects that out of 21 witnesses to be examined, 10 witnesses have already been examined.

Learned Advocate appearing for the petitioner submits that the petitioner is in custody since 30 April 2020 i.e. more than 3 years and 8 months.

In view of the period of detention of the petitioner I direct the learned Trial Court to fix a schedule consisting of three dates and fix the schedule once in every 15 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time as already the petitioner is in custody for 44 months. In case any witness is absent the Superintendent of Police, Murshidabad police district would take steps for ensuring the presence of the witness concerned. It is the Superintendent of

Police, Murshidabad police district who would engage a Nodal Officer in this case for ensuring the presence of the witnesses on the date so fixed. No unnecessary adjournment should be granted to either of the parties.

The learned Public Prosecutor conducting the case would produce materials, exhibits on the date so fixed for examination of witnesses concerned. In case any difficulty of production of any materials immediately the Nodal Officer be informed by the learned Public Prosecutor.

All efforts be taken to conclude the trial by 31st December, 2024.

With the aforesaid observations CRR 4086 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
