In Re. : CAN 1/2023 16-10-2023 AKG Ct. 238 Having regard to the nature of disputes involved, I am of the view that there is no reason to add the applicant as a respondent in this writ petition at this stage.

Accordingly, CAN 1/2023 is disposed of.

However, dismissal of the application will not prevent the applicant from taking steps in accordance with law.

In Re. : WPA 24469 of 2023 It appears that the relevant consortium of JRS Education Trust, Nirmala Foundation and JMN Education and Research Foundation was allowed to be

reconstituted by an order dated September 26, 2023 by the State. Following the said order, the Principal Secretary, Department of Health & Family Welfare of the State by a letter dated September 29, 2023 requested the Chairman, Medical Commission to allow further round of counselling after September 30, 2023 with provision of ten days in order to fill up the remaining vacancy in medical colleges in the State of West Bengal. I am of the view that the last date of admission i.e. September 30, 2023 has been fixed by the Supreme Court of India and it is only for the Supreme Court to decide extension of the last date. In fact, it has been submitted by the parties before the Court that an application, seeking extension of last date of admission is pending before Supreme Court.

In that view of the matter, I am not inclined to pass any order regarding the extension of last date of admission.

Accordingly, WPA 24469 of 2023 is disposed of. However, this will not prevent the petitioner from taking any appropriate steps in accordance with law. Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
