Mr. Partha Pratim Das Mrs. Manasi Roy .....For the State Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 63 days and is innocent of the charges alleged against him. According to the learned advocate he has been falsely implicated in the instant case. Learned advocate on conclusion of the hearing intends to not press the application for bail. I have perused the Case Diary as produced by Mrs. Roy, learned appearing for the State.
The facts of the case relate to a fake job racket operating in a clandestine manner and, thereby defrauding the individuals. The role of the present petitioner is allegedly thickly connected with the offence. Having regard to the nature of the allegations, I am not inclined to grant bail to the petitioner, at this stage. Charge-sheet reflects that there are number of witnesses, I direct the Learned Magistrate in seisin
of the matter to complete the technicalities relating to supply of copies under Section 207 of the Code of Criminal Procedure, if required, learned Magistrate would prepone the date, effect supply of copies and frame the charges by 23rd December, 2022. The first six witnesses named in the charge-sheet should be examined by 15th February, 2023. The petitioner would be at liberty to pray for bail after the examination of the six witnesses are over.
