Earlier on 11.11.2024 and 03.12.2024 when the writ petition was called, accommodation was sought for on behalf of the petitioner.

Today when the writ petition has been called, none represents the petitioner.

No accommodation is sought for on behalf of petitioner.

Learned advocates for the State and private respondent nos. 4 to 8 are present.

Report submitted by the learned advocate appearing for the State be kept with the record. The said report reflects that essentially the dispute is relating to demarcation of a land. Police authorities at the relevant point of time, drew up proceedings under Sections 126/135 of BNSS as also Bhatar P.S. NCR No. 383 of 2024 dated 02.10.2024 under Sections 324(4)/351(2) of BNSS. Learned advocate appearing for the private respondent nos. 4 to 8 submits that a partition suit has already been preferred by the petitioner.

Having considered the totality of the circumstances, I am of the view that police authorities have hardly any involvement so far as the property and/or its disputes are concerned. Police authorities would only act if there is violation of law and order.

With the aforesaid observations, the writ petition being WPA 25646 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
