Mr. Pinaki Bhattacharyya, Mr. Amartya Mohan Bhattacharyya ... for the petitioner Mr. Radhamohan Ray ... for the WBSEDCL Ms. Kavita Rani ...for the private respondent When the matter is called on for hearing, learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) seeks to file an inspection report.

However, it is submitted by learned counsel appearing for the private respondent no. 5 that the inspection was not held in the presence of the private respondent no. 5 or with prior notice to the private respondent no. 5.

As such, since there is nothing contrary on record to controvert such allegation of the private respondent no. 5, the WBSEDCL is directed to hold an inspection afresh and file a fresh report upon prior notice in writing to the petitioner as well as the private respondent no. 5.

Such report, upon circulation of prior copies of the same to the learned advocates for the petitioner as well as the private respondent no. 5, shall be filed in court on December 20, 2022, when the matter shall next be listed under the same heading.

The report sought to be filed today by the learned advocate for the WBSEDCL is not taken on record for the above reasons.
