Ray Mr. Arijit Majumdar ..........for the Union of India By an order dated June 27, 2023, this Court had directed that the order of transfer of the petitioner from Kolkata to ASG, Bhubaneswar to be considered taking into account the fact that the petitioner's son is only 6 years of age. The said order was passed in WPA 14210 of 2023. The petitioner in the previous writ petition challenged a transfer order dated May 23, 2023.

The representation of the petitioner was considered and by an order dated August 14, 2023 the authorities concerned rejected her prayer. It is stated in the impugned order that since the petitioner's husband is serving in Kolkata Police, under the West Bengal Government, he will stay in Kolkata during this service tenure. The petitioner is serving in a Paramilitary Force (Central Industrial Security Force) and posting her indefinitely in

Kolkata is neither desirable nor possible in a disciplined, Central Armed Paramilitary Force. Considering the rival submissions of the parties and the materials placed on record, this Court is of the view that since the petitioner's son is only 6 years of age, her prayer for being stationed in Kolkata or around Kolkata may be considered by the Director General, CISF, Head Quarters or any other authority delegated by him within a period of 8 weeks from date. A reasoned order may be passed and communicated to the petitioner within 2 weeks of passing thereof.

With the directions aforesaid, WPA 24478 of 2023 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
