-vs- The State of West Bengal & Ors.

Mr. Mahammad Mahmud Mr. Pinaki Das ... for the petitioners.

Mr. Ziaul Islam Mr. Abdus Salam ... for the State.

Ms. Aparajita Mondal Mr. Biplab Adak ...for the respondent no. 10 This writ petition is taken up for hearing in presence of the learned advocates representing the writ petitioners, State respondents and the respondent no. 10. Other respondents are not represented.

During the course of hearing of the writ petition attention of this Court has been drawn to one Memo dated 15th April, 2016 issued by the Additional District Magistrate and District Land and Land Reforms Officer, Hooghly, addressed to the Block Land and Land Reforms Officer, Dhaniakhali, Hooghly, whereby the concerned Block Land and Land Reforms Officer was

requested upon enclosing a petition to dispose of the matter under Section 20B of the West Bengal Land Reforms Act.

On hearing the writ petition and also perusing the representation of the petitioners dated 23rd September, 2016 at page 30 of the writ petition it appears that a dispute relates to Barga recording in the name of the petitioners vis-à-vis the private respondents.

Therefore, this Court does not have the jurisdiction to entertain the present writ petition and accordingly the same stands dismissed.

However, this order shall not preclude the writ petitioners to approach the appropriate forum in accordance with law, if so advised.

Affidavit of service is filed on behalf of the writ petitioners is taken on record.
