1. Affidavit-of-service filed in Court today be kept with the records.

2. The matter relates to the selection process of Assistant Headmaster in a Government aided school.

3. The petitioners are the intending candidates. They allege that the selection was not done in a free and fair manner. Members of the Managing Committee were forced and pressurized to award high marks to the candidates of their choice.

4. An objection was forwarded by the School Managing Committee to the District Inspector of Schools (S.E), Malda. No step in response thereto is alleged to have been taken. Prayer has been made to direct the school to conduct the recruitment process in a free and fair manner.

5. Learned advocate representing the State respondents admits the allegations made by the petitioners. It has been submitted that upon perusal of all documents from the school, the District Inspector of Schools has opined not to approve the panel as the selection process lacked fairness and impartiality.

6. The District Inspector of Schools has communicated the fact to the Headmaster of the School by a communication dated 7th November, 2025.

7. As it appears that the panel forwarded by the School has not been approved by the District Inspector of Schools, the School ought to take steps for concluding the selection process in accordance with law in a free, fair and transparent manner.

8. To maintain fairness in the selection process, the School shall ensure that the process of interview is videographed and the video recording be preserved and be placed before the authority as and when called for. Any person not connected with selection process shall be permitted to interfere with the same.

9. The District Inspector of Schools shall ensure that the selection process is not interfered with by any third party.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
