Learned advocate appearing for the petitioner submits that the present case involves alleged recovery of 22.280 kg of ganja and there was a partial recovery of more than 8 kg of ganja from the possession of the present petitioner. Petitioner is in custody for 10 months and till date charges have not been framed.

Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized.

Having considered that the petitioner is in custody for 10 months and the quantum of contraband seized, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Prince Polen shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, 1st Court, Barrackpore, North 24 Parganas.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of North 24 Parganas without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1404 of 2025 is allowed.
