Present petition has been filed for expeditious disposal of the case being M. Case No. 173 of 2019 pending before the learned 3rd Court Judicial Magistrate, Barrackpore under Section 125 of the Code of Criminal Procedure.

Learned counsel for the petitioner submits that appropriate directions may be issued for the disposal of the matter in three months.

The Court has considered the submissions. Perusal of the records indicates that the present proceedings are filed in February, 2019. The case is at the stage of cross-examination of the petitioner. Section 125 Cr.P.C. is a piece of benevolent legislation and the intention of the legislature is to provide speedy relief. The Court considers that no prejudice shall be caused to the other party, if a direction is issued for the expeditious disposal.

In the facts and circumstances, learned Trial Court is directed to conduct expeditious disposal of the case being M. Case No. 173 of 2019 without granting any unnecessary

adjournments in accordance with law as to the statutory provisions.

Accordingly, the present petition is disposed of. 6.
