The present revisional application was preferred against the order dated 20.07.2013 passed by the learned Sessions Judge, Nadia at Krishnagar in connection with Criminal Appeal No.8 of 2013.

The genesis of the appeal relates to the order dated 27.08.2012 passed by the learned Judicial Magistrate, 4th Court, Krishnagar, Nadia in connection with Criminal Misc. Case No.177 (iv) 2011 under Sections 18/19/20/21/22 of the Protection of Women from Domestic Violence Act, 2005.

I have perused the order dated 20th July, 2013 wherein the learned Sessions Judge was pleased to allow the application under Section 5 of the Limitation Act subject to payment of cost of Rs.1,000/- and directed that on making such payment, the appeal will be admitted.

Having regard to the order so passed which was for the purposes of consideration of the provisions of Limitation Act, I am of the opinion that there is no illegality in the said order. No interference, as such, is called for.

Accordingly, CRR 2879 of 2013 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
