26.11.2025 Court No.35.
D/L. 218.
Rakib (Rejected) CRM (M) 2238 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chakdah Police Station Case No. 877 of 2025 dated 09.08.2025 under Sections 420 of the Indian Penal Code, 1860 read with 14 of the Foreigners Act, 1946.
And In the matter of : Shankar @ Sankar Biswas ......Petitioner.
Mr. Shibaji Kr. Das Ms. Deblina De ......for the Petitioner.
Ms. Subhasree Patel Mr. Rahul Ghosh ......for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for a considerable period of time and he has documents in his custody to prima facie establish that he is an Indian citizen.
On the other hand learned advocate for the State has produced the Case Diary.
Case Diary reflect documents which also reveals substantial materials connecting the petitioner and prima facie establishing that the petitioner has documents as a Bangaladeshi national.
Considering the same, I am of the opinion that this is not a fit case for granting bail to the petitioner. Accordingly, CRM (M) 2238 of 2025 is dismissed.
If there are any disputed questions of facts regarding the documents, petitioner would take up the same before the learned trial Court for establishing his right. Case Diary be returned to the learned advocate appearing for the State.
