The subject matter of challenge relates to the order dated 21.05.2013 passed by the learned Additional Principal Judge, Family Court, in Miscellaneous Case No.28 of 2011 under Section 125 of the Code of Criminal Procedure.
Records of the revisional application reflects that by the said order the learned Judge was pleased to award maintenance of Rs.7,000/- per month on and from 17.05.2011 (which was a date of filing of the application) under Section 125 of the Code of Criminal Procedure.
Having regard to the reasons so assigned by the learned Judge, I do not find any illegality in the said order. Further, the said order was passed in the year 2013 and there are total change of circumstances in the meantime. If there are change of circumstances, the petitioner would approach the same court by invoking the appropriate provisions of law for enhancement of maintenance. The learned court thereafter would consider the same in accordance with law.
With the aforesaid directions, CRR 2880 of 2013 is disposed of.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
