Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 23.5 kg of ganja from the joint possession of petitioner and another. Petitioner is in custody for about nine months and there is no possibility of the trial concluding in near future. As such, petitioner may be released on bail.

Learned advocate for the State on the other hand opposes the prayer for bail and submits that the quantum of contraband seized is of commercial quantity.

I have taken into account the quantum of contraband as also the period of detention of the present petitioner. Having regard to the same, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Sajibul Sk @ Iqbal Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Learned Additional District & Sessions Judge, 2nd Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1405 of 2025 is allowed.
