Report so submitted by Mr. Swapan Banerjee, learned advocate appearing for the State be kept with the record. Report has been prepared by Sub Inspector of Police, Detective Department, Howrah Police Commissionerate. Report reflects that the petitioner is innocent of the charges and he had no complicity in the alleged offence regarding the use of the vehicle. The petitioner happens to be owner of the vehicle and by virtue of an agreement/power of attorney the vehicle belongs to the accused. According to the Investigation Authorities the seized vehicle is no longer required for the purpose of investigation but the same is required for evidence during the trial. On the basis Investigation report submitted by Investigating Officer, the Learned Special Court is directed to release the vehicle on such conditions, so that the vehicle is made available during the evidence for the purposes of the trial of the case. The amount of bond and the condition would be imposed by the learned Special Court.

With the aforesaid observations, CRR 3467 of 2017 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any is hereby vacated.
