1. Challenging the termination order dated 27th July 2019 issued under Rule 3(1) of the West Bengal Government Premises (Tenancy Regulation) Act, 1976, the present writ petition has been preferred.

2. Mr. Kamal Kumar Chattopadhyay, learned Advocate appearing on behalf of the respondent nos. 1 to 3, submits that since the petitioner failed to start its business within the time stipulated in the lease agreement, the entire agreement was terminated. He submits that subsequently the respondents have taken possession of the land in question and with the passage of time the present writ petition has become infructuous.

3. The record reveals that since the date of filing, the petitioner did not take any efforts to press the matter.

4. Considering this aspect, I am of the view that with the passage of time, the instant writ petition has become infructuous and the same is, accordingly, dismissed.

5. There shall, however, be no order as to costs. (Partha Sarathi Chatterjee, J.)
