Mr. Kalidas Saha Ms. Khushi Mollick ...for the petitioner Mr. Partha Pratim Das Mr. Parvej Aman ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The accused and the alleged victim are all brothers. The brothers had decided to sell a property for the treatment of their father. The victim took advantage of this situation and got a portion of the land transferred in his name without consent. This led to an altercation. The petitioner surrendered before the concerned Court and is now in custody for about eleven months. Learned counsel appearing on behalf of the State opposes the prayer for bail. He refers to the statements of the victim recorded before the learned Magistrate, the injury report which shows a stab injury on the abdomen. He also refers to statements of other witnesses.

Considering the length of custody undergone by the petitioner and the fact that the charge sheet has been submitted, I am inclined to grant bail to the petitioner.

Accordingly, the application for bail of the petitioner is allowed.

Let the petitioner be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned CJM, Malda and also be subject to the conditions that the petitioner shall appear before the trial Court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

The application for bail is, thus, disposed of. (Jay Sengupta, J.)
