Learned advocate appearing for the petitioner has expressed agony and anxiety to the effect that in spite of Patashpur P.S. Case no. 430 dated 17.08.2024 was registered for investigation on the basis of information furnished by the present petitioner, yet the petitioner had been facing inconveniences and insecurity because of the private respondents whose overt acts resulted in interfering with the peaceful enjoyment of her and her family's life and liberty.

State has submitted a report which reflects that in connection with the aforesaid criminal case, charge-sheet has already been submitted against the accused persons. Another incident has been referred to on 16.09.2024 by the petitioner for which proceedings have been drawn up under Section 126 of the BNSS.

Be that as it may, the averments in the writ petition reflect that several criminal cases and counter cases are pending inter se the parties. However, the

petitioner has informed the local police station that they are receiving threats and are unable to return to their home because of the insecurity.

Since, a criminal case has been pending before the jurisdictional Court, petitioner will apply before the jurisdictional Court in seisin of the issue under the relevant provisions of Witness Protection Scheme, 2018. Learned Court would assess regarding the threat perception of the petitioner and would ensure their protection, in case they return to their own property. With the aforesaid observations WPA 25729 of 2024 is disposed of.
