1. We have heard the learned Counsel for the parties extensively. 2.

It appears that the learned Special Judge, NDPS Court on 27th March, 2019, upon recording that there is reason to believe that the present petitioner has absconded and concealing himself and that the warrant could not be executed in spite of repeated attempts, passed an order under Section 82 of the Criminal Procedure Code whereby written proclamation was issued directing the said accused to appear before the Court on 15th May, 2019. 3.

The Officer-in-Charge filed a report on 6th December, 2023. The learned Special Judge, inter alia, passed the following order: "It is true that till date the accd Safik Laskar is not found available for the trial, but considering the steps taken against him as reflected in the record this court does not find any reason or scope to declare accd Safik Laskar @ Pintu as proclaimed offender any further at this stage.

Accordingly, the Court is of the opinion that the petition and prayer of the prosecution dtd 6.12.2023 calls for no order at this stage and be disposed of."

In view of the subsequent order, Mr. Sudipto Maitra, learned Senior Counsel appearing for the petitioner has submitted that the order impugned has now become infructuous.

We accept the said submission on behalf of Mr. Maitra and dispose of this application by reason of the subsequent order dated 6th December, 2023 which was passed on consideration of the report filed by the Officer-inCharge. 6.

However, we make it clear that we have not gone into the merits of the matter.

This order shall not prevent the petitioner to seek any remedy, if available in law.

8. CRR 4097 of 2023 and CRAN 1 of 2023 are accordingly, disposed of.
