Ct.No.28 as (Rejected) C.R.M. (DB) 4040 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dholahat P.S. Case No.411 of dated 17.10.2021 under Sections 367/368/370 of the Indian Penal Codeand Sections 354B/372/373/376/120B/201 of the Indian Penal Code and Sections 6/8 of the POCSO Act.
In the matter of : Manowar Hossain Halder @ Mono. ... Petitioner.
Mr. Bibaswan Bhattacharya.
...for the Petitioner.
Ms. Faria Hossain, Mr. Anand Keshari.
...for the State.
Petitioner renews his prayer for bail. He submits he is in custody for 390 days. He has been falsely implicated in the instant case.
Learned Advocate for the State opposes the prayer for bail. He submits trial has commenced and vulnerable witnesses i.e. minors trafficked for sexual exploitation are yet to be examined.
We have considered the materials on record. Statements of witnesses shows petitioner and his family members were carrying on a racket of prostitution and trafficking of minors. Charge has been framed and the vulnerable witnesses are about to be examined.
At this stage, we do not consider it prudent to release the petitioner on bail lest it may have adverse impact on the vulnerable witnesses.
Under such circumstances, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
