The writ petitioners aggrieved that Andal Police Station has not taken any steps to hand over the secured assets despite an order dated 5th August, 2021 passed by the District Magistrate, Paschim Bardhaman under Section 14 of the SARFAESI Act, 2002.

The petitioners have thereafter deposited a sum of Rs.98,087/- as demanded towards costs of providing security for delivery of possession of secured assets.

In the backdrop of the aforesaid, this Court directs the Commissioner of Police, Asansol Durgapur Police Commissionerate and Andal Police Station to deploy sufficient force to deliver the secured assets to the petitioners on 19th January, 2023 at 2:00 P.M. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
