The petitioner seeks an electricity connection for his premises at Plot No. 831/883, Nishchintapur, Budge Budge, South 24 Parganas.
The report filed by the West Bengal State Electricity Distribution Company Limited (WBSEDCL) indicates that three poles are required to be erected on a passage in order to effect the connection in favour of the petitioner. However, Sudipto Ghosh, Sougato Ghosh, and Snigdha Biswas have objected to the installation of the electric poles, claiming ownership of the said passage.
Whether any way-leave permission is required from the objectors is a matter to be determined by the concerned District Magistrate.
Accordingly, the writ petition is disposed of with a direction upon WBSEDCL to approach the
concerned District Magistrate within a period of two weeks from date, in terms of Rule 3(b) of the Works of Licensees Rules, 2006.
The concerned District Magistrate shall decide the issue within a period of three months from the date of such approach, after giving an opportunity of hearing to all concerned parties, including the petitioner. A reasoned order shall be passed and communicated to the petitioner forthwith.
Accordingly, WPA 24524 of 2023 stands disposed of.
