Petitioner's mother was an employee of Eastern Coal Fields Limited who died-in-harness on 20th March, 2003.

Petitioner being son of the deceased employee who is one of the heirs has approached this Court with the present writ petition claiming release of provident fund dues which was not paid to the husband of the deceased employee and it is submitted that husband also died.

Learned advocate representing Eastern Coal Fields Limited submitted that petitioner is required to submit formal claim for release of provident fund in his favour.

Having considered the submissions made on behalf of the parties, leave is granted to the petitioner to lodge a claim by making a representation before the General Manager (ECL), Bankola Area, Paschim Bardhaman being respondent no.5 by fortnight

from date claiming release of provident fund. 5.

If such representation is lodged within the aforesaid time, respondent no. 5 is directed to take necessary steps and decide the claim of the petitioner by six weeks thereafter.

Respondent no.5 shall pass a reasoned order after granting opportunity of hearing to the petitioner or his representative.

With the aforesaid direction, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
