Advocate for the petitioner challenges the warrant of arrest which was issued in the order dt. 14.9.2023 passed by the ld. District Consumer Disputes Redressal Commission, South 24 Parganas.

The judgment delivered by a Co-ordinate Bench in CRR 2955 of 2022 (Samasth Infotainment Pvt. Ltd. & Ors.- vs.- The State of West Bengal & Ors.) and the observations made therein are as follows:

"Every order made by a District Commission, State Commission or the National Commission shall be enforced by it in the same manner as if it were a decree made by a Court in a suit before it and the provisions of Order XXI of the First Schedule to the Code of Civil Procedure, 1908 (5 of 1908) shall, as far as may be, applicable, subject to the modification that every reference therein to the decree shall be construed as reference to the order made under this Act." In view of the judgment and the observations made therein, I am of the view that the order dated 14.9.2023 calls for interference and the same is set aside.

The ld.

District Consumer Disputes Redressal Commission in Execution Application no. 35 of 2022 is directed to abide by and follow the mode and manner in which the directions have been passed in CRR 2955 of 2022 by the Hon'ble High Court, Calcutta.

With the aforesaid observations, CRR 4099 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
