The petitioner is aggrieved that a complaint against the private respondent Nos.6 and 7 has not been investigated by the Chakdaha Police Station. 2.

Learned counsel for the State has produced a report in the form of instructions issued by the Inspector-in-Charge, Chakdaha Police Station, Nadia addressed to the learned Government Pleader and the same is taken on record.

The report states that the dispute is purely civil in nature. The petitioner obtained a loan from the Nadia District Co-operative Bank Limited for purchase of a tractor and did not pay back the same. The tractor has been repossessed by the Bank. Huge sums of money are due and payable to the Bank.

This Court is of the view that the dispute is civil in nature and the Chakdaha Police have no role to play in the matter.

Reserving liberty to the rights of the petitioner to approach the Civil Court against the private respondents or the Bank, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
