Mr. Dipankar Mandal ...for the petitioner Mr. Koushik Roy ...for the WBSEDCL The erstwhile Advocate appearing for the petitioner submits that he has got instruction that the original petitioner had died in the meantime, but his legal heirs have not instructed the learned Advocate as yet to appear and proceed with the matter.

In such view of the matter, since the petitioner is no longer in the world of the living, W.P.A. No. 19837 of 2009 is dismissed as abated.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.

However, this order will not prevent the heirs of the petitioner, if any, from taking out an appropriate application upon service of a copy of the same on the WBSEDCL and other respondents, if any.
