Mr. Ranadeb Sengupta, For the State It is reported by Assistant Registrar - XII on 04.01.2025 that there are certain anomalies in listing the relevant matters as aforesaid on 13.08.2021. The report of the Assistant Registrar - XII is reproduced herein below:- "It is most humbly submitted that in terms of the Hon'ble Court's Order Dated 10.01.2006 the Hon'ble Justice S. P. Talukdar was pleased to direct the matters being CRR 3783/05, CRR 3784/05, CRR 3785/05, CRR 3888/05, CRR 3889/05 and CRR 3890/05 to be listed along with CRR 3782/05 on the next date of hearing. In obedience to the direction, the department had tagged the said
analogous files with CRR 3782/05.
However, there had been a typographical error while listing the matters on the causelist of 13.08.2021 wherein the last three case numbers were printed as CRR 3788/05, CRR 3789/05 and CRR 3790/05 instead of CRR 3888/05, CRR 3889/05 and CRR 3890/05 [at Flag-A]. The same fallacy occurred in the next causelist of 16.09.2021 again [at Flag-B] thus resulting in a simultaneous anomaly in the case number of the ordersheets dated 13.08.2021 and 16.09.2021.
In this context, it is pertinent to mention that the cause title of CRR 3788/05, CRR 3789/05 and CRR 3790/05 appears to be different from the original cause title of the aforestated anologous matters as found from the movement history in CIS [at Flag-C] wherein it is also observed that the said files have been already sent to NRD.
Under the abovementioned circumstances, the entire matter is now being placed before the Hon'ble Court for kind consideration and necessary order."
From the said report, it is transpired that as per direction of the Hon'ble Court on 10.01.2006 the matters being CRR 3783/05, CRR 3784/05, CRR 3785/05, CRR 3888/05, CRR 3889/05 and CRR 3890/05 were to be listed along with
CRR 3782/05 on the next date of hearing. As per direction the department had tagged the said analogous files with CRR 3782/05. It is further reported that there had been a typographical error in the cause list dated 13.08.2021 wherein the last three case numbers namely viz. CRR 3888/05, CRR 3889/05 and CRR 3890/05 had been wrongly printed as CRR 3788/05, CRR 3789/05 and CRR 3790/05 respectively and the same fallacy had occurred in the next cause list dated 16.09.2021 also.
After going through the entire report along with annexures, it appears that the anomalies as stated above were occurred inadvertently in the cause lists dated 13.08.2021 and 16.09.2021. It further appears that due to oversight such anomalies persist in the cause title of the order sheets dated 13.08.2021 and 16.09.2021. As, such mistakes occurred due to oversight, I direct the department concerned to make necessary correction in the cause title of the order sheets dated 13.08.2021 and 16.09.2021.
The learned counsel for the State Mr. Sengupta has also submitted that such anomalies are required to be removed immediately.
The department is to take appropriate action accordingly.
