41 kilograms of ganja was recovered from a Maruti vehicle. The petitioner says that he has no connection with that vehicle.

The State produces a certificate from the Regional Transport Officer, which shows that the petitioner is the owner of the vehicle bearing registration no. WB52BH 5347. The charge sheet reflects that the seizure was from the vehicle bearing that registration number. This prima facie shows that the petitioner is the owner of the vehicle from which huge quantity of ganja was seized. 3.

In view of the aforesaid, keeping in mind the restrictions in Section 37 of the NDPS Act, we are not inclined to enlarge the petitioner on bail, at this stage. 4.

The prayer for bail is rejected.
