Mr. Lakshminath Bhattacharya ....for the petitioner Mr. Avirup Mondal Mr. Kartik Chandra Kapas ....for the State Affidavit of service filed in Court today is taken on record.

The petitioner claims to the owner of L.R. Dag No.7372 and 7373, Khatian No.3435 and 3149 within Mouza-Dakshin Gangadharpur under Police StationParthar Pratima in the District of South 24-Parganas. The petitioner alleges that for the purpose of implementation of the government scheme for construction of roads, the respondent authorities particularly the Panchayat authorities are taking steps for constructing a road over the aforesaid plots of land of the petitioner without initiating any proceeding for requisition or acquisition. The petitioner forwarded a representation to the various authorities by speed post on October 28, 2025.

Mr. Bhattacharya, learned advocate appearing for the petitioner submits that no steps have been taken by the respondent authorities pursuant to representation submitted by the petitioner.

The learned advocate appearing for the State submits that the concerned Block Development Officer be directed to consider the representation of the petitioner and to pass necessary orders thereupon.

In the light of the submissions made by the learned advocates for the respective parties, WPA 25247 of 2025 stands disposed of by directing the Block Development Officer, Parthar Pratima Block, being the respondent No.10 to consider the representation of the petitioner which is appearing at page 31 of the writ petition and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner, the authorities of the concerned Panchayat or any other person whose interest may be affected by such decision. The reasoned order shall be communicated to the petitioner and other respective parties immediately thereafter.

The entire exercise shall be completed as expeditiously as possible but within a period of 4 weeks from the date of receipt of a server copy of this order along a copy of the representation which is appearing at page 31 of the writ petition.

There will be no order as to costs.
