Learned advocate for the petitioner submits that the petitioner being Group-D staff of Government aided school made transfer application on medical ground and the same was processed by the school authority and was forwarded to the concerned District Inspector of Schools (SE). It is also submitted that on medical verification the concerned CMOH by issuing certificate dated 28th March, 2022 has opined in favour of the petitioner and the said certificate is at page 18 of the writ petition. It is also submitted that after medical verification made by the concerned CMOH, the concerned District Inspector of

Schools forwarded the transfer application of the petitioner to the office of the Commission on 29th March, 2022 and the issue is pending before the Commission for taking final decision.

Mr.

Roy, learned advocate representing the Commission submits on instruction that in one of the preferred schools as indicated by the petitioner in his transfer application his position is first.

In view of the submissions made by the learned advocates representing the parties, the writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.3 to take decision on the transfer application of the petitioner by fortnight from the date of communication of this order and the decision to be taken by the respondent no.3 shall be communicated to the petitioner within one week thereafter.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings. (Saugata Bhattacharyya, J. )
