1. Regard being had to the similitude of the question involved, on the joint request matters are analogously heard.

2. In MAT 1904 of 2025, CAN 2 of 2025 is filed seeking leave to file the intra-Court appeal because the appellant herein was not a party before the learned

Single Bench. In absence of opposition CAN 2 of 2025 is allowed.

3. During the course of hearing learned counsel for the parties reached to a consensus. It is agreed that the respondent in MAT 1905 of 2025 shall not hold the rally tomorrow i.e. 5th November, 2025 and in lieu thereof he will hold the same rally on 9th November, 2025.

4. Mr. Kalyan Bandopadhyay, learned senior advocate for the State agreed that for 9th November, 2025 the permission shall be treated to have been granted to hold such rally which was scheduled on 5th November, 2025.

5. Learned counsel for the appellant in MAT 1904 of 2025 also does not have any objection.

6. In view of consensus arrived at, both the appeals are disposed of directing the parties to act in accordance with their stand taken hereinabove. The legal question raised shall remain open to be decided in appropriate case. Needless to emphasize that the impugned order of the learned Single Judge stand modified in tune of what has been stated hereinabove.

7. With the disposal of the appeals, all interlocutory applications are disposed of.
