Ms. Sananda Das Mr. Priyam Misra Mr. Amitava Chakraborty Ms. Ankita Mishra ....for the petitioner Mr. Suman Ghosh ....for the CESC Limited Mr. Suman Nandi ....for the private respondent nos. 3, 4 and 5 The grievance of the petitioner is directed against the refusal of the CESC Limited in providing an electricity connection to the premises of the petitioner.
It is submitted on behalf of the petitioner that there are third parties who are creating obstruction and preventing the CESC Limited from providing such connection.
On behalf of the CESC Limited, a Report dated 10.06.2026 has been filed wherefrom it appears that the only reason for CESC Limited not being able to provide such electricity connection is the objection of third party private respondents. On behalf of the private respondents, it is submitted that any connection is to be provided from a separate area and not where the common meter box is located.
In view of the fact that the premises in question is one single premises being premises No. 124 S.P. Banerjee Road, there is no merit in the objection raised on behalf of the private respondent. In view of the submissions made on behalf of the parties, WPA 25346 of 2025 stands allowed by directing the CESC Limited to provide an electricity connection to the premises of the petitioner. Liberty is granted to the CESC Limited to take police assistance if the circumstances so warrant. Any expense of charges for such assistance should be exclusively borne by the petitioner.
The above exercise is to be completed expeditiously preferably within a period of four weeks from the date of communication of this order. Liberty is also granted to the police officials to break open any padlock at the subject premises, if the occasion so arises.
CAN 1 of 2026 CAN 1 of 2026 is for restoration and has been allowed pursuant to an earlier order of Court. The Department is directed to correct the records to reflect that CAN 1 of 2026 stands disposed of.
