Petitioner contends there was a free fight. Case and counter case have been registered. Allegation of attempt to rape is an embellishment. Accordingly, he prays for anticipatory bail. 2.
Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. There was a free fight between the parties. Case and counter case have been registered. Possibility of embellishment owing to prior enmity cannot be ruled out.

Keeping in mind these facts, we are of the opinion custodial interrogation for progress of investigation is not necessary and petitioner may be granted anticipatory bail. 5.
Accordingly, we direct that in the event of arrest, the petitioner viz., Ratan Roy be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to Signed By : ALOK SETH High Court of Calcutta 13 th of November 2024 04:59:26 PM
the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the BNSS. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
